The FBI has determined that Delaware marijuana background checks do not meet its standards.
After working with the State Bureau of Identification and the Delaware Department of Justice to secure a FBI service code to conduct the required criminal background checks for the adult use recreational marijuana market, the FBI notified the state late Friday that its reconsideration request is denied.
The FBI advised that Title 4 of the Delaware Code must contain language explicitly identifying the categories of persons required to obtain a background check..
The Delaware Office of the Marijuana Commissioner will work with the General Assembly to develop proposed legislation containing criteria that is satisfactory to the FBI, a release stated.
The hold-up is likely to further delay the opening of recreational marijuana stores and grow sites.
It is not clear why regulators were unaware of the FBI requirements or if those standards changed at some point.
Earlier, the previous marijuana czar left the position, leading to concerns about delays in getting a retail system up and running.
Restrictions by counties and municipalities have also led to problems with license awardees finding store space. It is said to be virtually impossible to find suitable space in Sussex County.
By contrast, medical marijuana providers may be in better shape if allowed to use their current sites to sell recreational weed.
Those supporting medical marijuana claim delays only strengthen the illegal market.
Possession of small amounts of marijuana is no longer illegal.
