We'll soon see the resolution of a lawsuit filed by landlords and hotel owners over a hasty change in the formula for taxing businesses and residences.
Following an outcry from residential property taxpayers over double-digit increases in property tax bills after the recent reassessment, school districts shifted a larger share of the burden to businesses. It came after a rare special session of the General Assembly cleared the way for the change.
Naturally enough, businesses most affected by the change fought back with a lawsuit filed in Chancery Court. Lurking in the background were some head-scratching business reassessment figures. That issue will have to be sorted out later.
Both parties are fortunate to have the legal expertise and body of law that's in the DNA of the Chancery Court in resolving this suit. Any ruling can be appealed to the State Supreme Court.
Presiding over the case is highly regarded Vice Chancellor Lori Will. Will fast-tracked the lawsuit, and we should see a ruling in the coming days.
One side or the other will not be happy. But it is good to know that this matter was heard in a court with legal tools that are tailor-made for issues like this. - Doug Rainey, chief content officer.
